1.2 " T e i l n e h m e r " i s t d i e n a t ü r l i c h e o d e r j u r i s t i s c h e P e r s o n ,
die m i t dem B e t r e i b e r e i n e Benutzungsvereinbarung
abgeschlossen h a t .
1.3 D e r Te i l n e h m e r d a r f s e i n M a i l b o x f a c h a u c h A n g e s t e l l t e n
und M i t a r b e i t e r n z u r V e r f ü g u n g s t e l l e n u n t e r d e r
Vo r a u s s e t z u n g , d a ß e r f ü r a l l e a u s d i e s e r B e n u t z u n g
entstehenden Kosten u n d d i e E i n h a l t u n g d e r
Benutzungsbedingungen p e r s ö n l i c h h a f t e t .
1.4 Z u a n d e r e n Te i l n e h m e r n d e s M a i l b o x - S y s t e m s w e r d e n k e i n e
rechtsgeschäftlichen Beziehungen begründet.
2. L e i s t u n g e n d e s M a i l b o x - S y s t e m s
2.1 D i e L e i s t u n g e n werden d u r c h d i e B e d i e n u n g s a n l e i t u n g s o w i e
AleN d i e i m B r e t t S Y S I N F O - D v e r ö f f e n t l i c h t e n M e l d u n g e n
bestimmt.
F o l g e n d e G r u n d l e i s t u n g e n k ö n n e n v o n z a h l e n d e n Te i l n e h m e r n
i n A n s p r u c h genommen w e r d e n :
- Senden u n d Empfangen v o n M a i l b o x - N a c h r i c h t e n ,
- Speichern von b i s z u 50 Nachrichten m i t maximal 100
Kilobyte,
- Lesen u n d Senden v o n B r e t t n a c h r i c h t e n . ( s o f e r n ö f f e n t l i c h )
Für d i e F u n k t i o n e n , d i e n i c h t zum r e g u l ä r e n M a i l b o x b e t r i e b
g e h ö r e n ( z . B . T E L E X , PROGRAMM u . { ) w e r d e n g g f s . b e s o n d e r e
Gebühren- u n d N u t z u n g s v e r e i n b a r u n g e n g e t r o f f e n .
3. V e r f ü g b a r k e i t d e s M a i l b o x - S y s t e m s u n d G e b ü h r e n
3.1 D i e M a i l b o x s t e h t g r u n d s ä t z l i c h u n u n t e r b r o c h e n z u r Ve r f ü g u n g .
Zu U n t e r h a l t u n g s z w e c k e n k a n n d a s S y s t e m j e d o c h k u r z z e i t i g
abgeschaltet werden.

der B e t r e i b e r k e i n e n E i n f l u s s h a t , b l e i b e n u n b e r ü c k s i c h t i g t .
3.3 W e i l d a s System n u r e i n e b e s c h r ä n k t e Anzahl v o n E i n g a n g s - und
Ausgangskanälen h a t , k a n n e s i n S t o ß z e i t e n z u B e s e t z t z e i t e n
kommen. D i e s e w e r d e n n i c h t a u f d i e V e r f ü g u n g s z e i t
angerechnet.
Ansprüche a u f S c h a d e n s e r s a t z s i n d a u s g e s c h l o s s e n .
3 . 4 D e r Te i l n e h m e r i s t f ü r d i e v o n i h m e i n g e s e t z t e n G e r ä t e
(Hardware u n d S o f t w a r e ) u n d i h r e Ta u g l i c h k e i t z u r
Kommunikation m i t d e r M a i l b o x s e l b s t v e r a n t w o r t l i c h . E i n
Ausfall s e i n e r Geräte entbindet n i c h t von der Verpflichtung
zur Zahlung d e r Gebühren.
3.5 D i e Nutzungsgebühren bemessen s i c h n a c h d e r j e w e i l s
g ü l t i g e n P r e i s l i s t e . S i e s e t z t s i c h zusammen a u s d e n
Vo l u m e n g e b ü h r e n s o w i e a u s G e b ü h r e n f ü r z u s ä t z l i c h e D i e n s t e .
3.6 E r f o l g t d i e Z a h l u n g gegen Rechnung, kommt e i n e Zusatzgebühr
10.00 DM zum R e c h n u n g s b e t r a g .
3 . 7 D i e K o s t e n f ü r T e l e f o n u n d D AT E X - P w e r d e n v o n j e d e m T e i l nehmer s e l b s t g e t r a g e n .
3.8 Beanstandungen des Rechnungsbetrages s i n d n u r i n n e r h a l b von
2 Wochen n a c h R e c h n u n g s d a t u m z u l ä s s i g . F ü r d i e B e h a u p t u n g ,
ihm b e r e c h n e t e K o s t e n s e i e n n i c h t v o n i h m o d e r s e i n e n
M i t a r b e i t e r n v e r u r s a c h t , i s t d e r Te i l n e h m e r b e w e i s p f l i c h t i g .
3 . 9 D i e R e c h n u n g s b e t r ä g e s i n d i n n e r h a l b v o n 2 Wochen a b
Rechnungsdatum f ä l l i g u n d o h n e A b z u g z u z a h l e n .
3.10 D e r B e t r e i b e r kann b e i Zahlungsverzug f ü r b e r e c h n e t e
Beträge d i e b i s zum Ende d e r 2 Monatswoche f ä l l i g waren
den A n s c h l u ß s p e r r e n b i s z u m A u s g l e i c h d e r f e h l e n d e n B e t r ä g e .

bei Vo r s a t z o d e r g r o b e r F a h r l ä s s i g k e i t .
4.2 J e g l i c h e H a f t u n g f ü r R i c h t i g k e i t , V o l l s t ä n d i g k e i t u n d / o d e r
A k t u a l i t ä t v o n I n f o r m a t i o n e n , B e d i e n u n g s h i n w e i s e n , Te x t e n ,
Auskünfte und Daten w i r d ausgeschlossen.
4 . 3 D e r Te i l n e h m e r v e r a n t w o r t e t , d a ß n u r e r u n d d i e j e n i g e n
Personen, d e n e n e r d e n Zugang zum M a i l b o x -System g e s t a t t e n
w i l l , i m Rahmen d e r B e n u t z u n g s b e d i n g u n g e n u n t e r B e a c h t u n g
der B e d i e n u n g s a n l e i t u n g d a s S y s t e m n u t z e n .

5. B e t r e u u n g
5.1 D i e B e d i e n u n g s i n f o r m a t i o n e n a m B r e t t SYSINFO-D
zu l e s e n , w i r d a n g e r a t e n .
5.2 F r a g e n z u r Nutzung d e s Systems s o l l e n s i c h a n d i e i m B r e t t
SYSINFO-D b e n a n n t e n B e t r e u e r w e n d e n . D e r B e t r e i b e r k a n n
f ü r B e r a t u n g u n d S c h u l u n g e i n e angemessene Gebühr b e r e c h n e n ,
s o f e r n d i e s ü b e r d a s Maß e i n e r n o r m a l e n B e r a t u n g h i n a u s g e h t .
6. D a u e r u n d Ä n d e r u n g e n
6.1 D i e Ve r e i n b a r u n g w i r d f ü r u n b e s t i m m t e Z e i t g e s c h l o s s e n . S i e
kann v o n b e i d e n P a r t n e r n m i t e i n e r F r i s t v o n 1 M o n a t z u m
Ende j e d e s K a l e n d e r q u a r t a l s g e k ü n d i g t w e r d e n ; d i e K ü n d i g u n g
bedarf d e r S c h r i f t f o r m .
6.2 S o l l t e n s i c h d i e b e h ö r d l i c h e n Vo r a u s s e t z u n g e n , i n s b e s o n d e r e
die p o s t r e c h t l i c h e n , f ü r den B e t r i e b von Mailboxen ändern
kann d e r B e t r e i b e r d e n B e n u t z u n g s v e r t r a g o h n e E i n h a l t u n g
einer Kündigungsfrist kündigen.

6.3 D a s R e c h t z u r f r i s t l o s e n Kündigung s t e h t dem B e t r e i b e r a u c h
zu, w e n n e i n Te i l n e h m e r m i t s e i n e n Z a h l u n g s v e r p f l i c h t u n g e n
in Ve r z u g g e r ä t .
6.4 D a r ü b e r h i n a u s h a t d e r B e t r e i b e r d a s Recht u n d d i e P f l i c h t
Te i l n e h m e r , d i e I n f o m a t i o n e n u n d / o d e r P r o g r a m m e ü b e r d i e s e n
System v e r b r e i t e n , d i e dem C o p y r i g h t o d e r U r h e b e r r e c h t s s c h u t z
u n t e r l i e g e n , u n d f ü r d e s s e n V e r b r e i t u n g d e r Te i l n e h m e r k e i n e
Berechtigung h a t , unbeachtet e t w a i g e r Schadensersatzanspüche
d r i t t e r von d e r Benutzung des Systems auszuschliessen und d i e
entsprechenden Informationen/Programme z u l ö s c h e n .
7. D a t e n s c h u t z u n d G e h e i m h a l t u n g
7.1 D e m Te i l n e h m e r i s t b e k a n n t , d a ß D r i t t e s e i n e N a c h r i c h t e n
lesen und weiterverwenden können und daß jedermann d i e
L e i s t u n g e n d e r M a i l b o x i n A n s p r u c h nehmen k a n n , s o f e r n

die K o m b i n a t i o n a u s o f f e n e m Benutzernamen u n d geheimem
Passwort b e k a n n t i s t . F ü r d e n S c h u t z s e i n e r I n f o r m a t i o n e n
i s t d e r Te i l n e h m e r s e l b s t v e r a n t w o r t l i c h - u n t e r a n d e r e m
durch Wa h l u n d r e g e l m ä ß i g e Ä n d e r u n g d e s P a s s w o r t s m i t
ausreichender Ungewöhnlichkeit.
7.2 D e r B e t r e i b e r s t e h t d a f ü r e i n , d a ß a l l e Personen, d i e m i t
der A b w i c k l u n g d i e s e s Ve r t r a g e s u n d d e r B e t r e u u n g d e s M a i l boxsystemes b e t r a u t s i n d , d a s B u n d e s d a t e n s c h u t z g e s e t z kennen
und b e a c h t e n .
7 . 3 D e r Te i l n e h m e r m a c h t s i c h s c h a d e n s e r s a t z p f l i c h t i g u n d e r k e n n t
dies a n , wenn e r u n b e f u g t d a s M a i l b o x -System dazu n u t z t ,
fremde, n i c h t f ü r i h n bestimmte D a t e n und I n f o r m a t i o n e n z u
erlangen o d e r d i e s e s v e r s u c h t . ( D e r Ve r s u c h i s t e b e n f a l l s
s t r a f b a r ! ) D i e d e n Te i l n e h m e r z u g ä n g l i c h e n A d r e s s e n l i s t e n d e r
anderen Te i l n e h m e r o d e r T e i l e d a v o n d ü r f e n n i c h t a n D r i t t e
w e i t e r g e g e b e n o d e r v e r ö f f e n t l i c h t w e r d e n . D e r Te i l n e h m e r i s t
d a r a u f h i n g e w i e s e n w o r d e n , d a ß e r m i t e i n e m B e f e h l (ADRESSE
NEIN) d i e P r e i s g a b e s e i n e r p e r s ö n l i c h e n D a t e n s p e r r e n k a n n .

8. A l l g e m e i n e s , G e r i c h t s s t a n d
8.1 Ä n d e r u n g e n u n d Ergänzungen d e r Ve r e i n b a r u n g e n b e d ü r f e n d e r
Schriftform.

Zweck d e r V e r e i n b a r u n g e n e n t s p r e c h e n d e o d e r n a h e k o m m e n d e

s i e d i e Unwirksamkeit d e r Bestimmung gekannt h ä t t e n .
